The Free Voice Organization expresses its strongest condemnation of the verdict issued by the Tunis Court of First Instance sentencing Professor Rached Ghannouchi to twenty years in prison in a case that lacks the most basic elements of a fair trial and clearly reveals the use of the judiciary as a tool to
eliminate political opponents. Free Voice affirms that this ruling came as the culmination of a procedural process marred by serious and grave violations, including the arbitrary arrest of Professor Rached Ghannouchi on the night of the 27th of Ramadan, corresponding to April 17, 2023, without prior summons, in flagrant violation of the most basic legal and human guarantees, and the denial of the right to defense by preventing lawyers from attending his hearing before the investigating judge for 48 hours, in clear violation of the principles of a fair trial. Furthermore, the arbitrary application of counter-terrorism legislation in a case unrelated to terrorism constitutes a serious deviation from the law’s intended purpose. Then, an arrest warrant was issued despite the proven fabrication of the video used as a key piece of evidence in the indictment, thus undermining the credibility of the entire case. We also strongly condemn the deliberate attempt to influence the course of justice and public opinion by leaking information and publishing posts declaring guilt before the start of interrogation proceedings a dangerous precedent that undermines the presumption of innocence. The Bar Association emphasizes that the statements attributed to its client during the Ramadan gathering fall within the framework of freedom of opinion and expression. These statements included an explicit call for coexistence, a rejection of exclusion, and an affirmation that Tunisia is inclusive of all its citizens, which makes the legal proceedings purely political in nature.
The commission also recalls that the Working Group on Arbitrary Detention has clearly determined that the arrest of Professor Rached Ghannouchi is arbitrary and that the underlying reason for his detention is related to the exercise of his fundamental rights, primarily freedom of expression. It also condemned the use of counter-terrorism laws against political opponents. Therefore, persisting in pursuing and convicting him despite this international decision constitutes a blatant violation of Tunisia’s international obligations and a serious breach of the principles of the rule of law and the independence of the judiciary.
Therefore, the Free Voice:<\/p>\n\n\n\n

  1. Condemns in the strongest terms this unjust ruling;<\/li>\n\n\n\n
  2. Holds the current authorities fully responsible for this dangerous perversion of the judiciary to
    target a political opponent of the stature and influence of Rached Ghannouchi, both domestically
    and internationally;<\/li>\n\n\n\n
  3. Warns of the serious repercussions of such practices on rights and freedoms in the country;<\/li>\n\n\n\n
  4. Declares its commitment to all legal rights, including appealing this ruling, despite its client’s firm
    conviction that the conditions for a fair trial were not met;<\/li>\n\n\n\n
  5. Calls upon all active forces and national and international organizations to confront this flagrant
